AGGRESSIVE DRIVING DEFINED:

Nevada's aggressive driving law states that a driver commits the offense of aggressive driving if, during the course of one mile, the driver commits any of the following, in any sequence:

1.    One or more acts of speeding in a school zone, or

    Speeding at a rate greater than reasonable or proper, in relation to traffic conditions, highway conditions     or the weather allow;

    Speeding that may endanger life, limb or property of any person;

    Speeding greater than the posted limit; or

    Speeding greater than 75 miles per hour.

2.    Two or more of the following acts, in any combination, or any of the following acts more than once:

    Failing to obey a traffic control device;

    Overtaking and passing another vehicle on the right by driving off the paved portion of the road;

    Improper or unsafe driving on a road that has marked lanes for traffic;

    Following too closely; and/or

    Failing to yield the right-of-way.

3.    Creates an immediate hazard to another vehicle or person.


PENALTIES:

If you are convicted of aggressive driving in Nevada, the court may sentence you as follows:

1.    First Offense:

    A fine from $250.00 to $1,000.00; or
   
    Both a fine and imprisonment in the county jail for up to six months; and

2.    Second Offense;

    A fine from $1,000.00 to $1,500.00; or

    Both a fine and imprisonment in the county jail for up to six months.

3.    Third and each subsequent offense:

    A fine from $1,500.00 to $2,000.00; or

    Both a fine and imprisonment in the county jail for up to six months.

In addition to the penalties listed above, there are other penalties you may incur if convicted of aggressive driving in Nevada.  For example, the court may sentence you to attend and complete a course of traffic safety (traffic school).  In addition, if you are convicted for a second time (or more) within two years from the date you were charged the first time for aggressive driving, your driver's license may be revoked for one year.
